Family Department Fixed Fees

If you are divorcing your Spouse/dissolving your civil partnership

£500 plus VAT and disbursements

Although you are paying a fixed price, we at Smith and Graham aim to provide each client with a unique service which caters for your individual needs.

To progress your matter we will begin by asking you to complete our Initial Client Questionnaire. This allows us to direct your case to the most appropriate fee earner within our family department.

You will then be invited to have an initial interview.  This can either be a face to face meeting with your solicitor, or a telephone appointment at a time convenient to you. 

Following our meeting, we will then write to you to provide you with an overview of the advice we have given.

If you have grounds for divorce we will prepare the court papers for your approval and signature and issue them at court on your behalf.When your spouse returns the Acknowledgement of Service to the court we will prepare a statement in support of your petition and the application for your Decree Nisi.We will apply for your Decree Absolute

In addition to the above, our clients will also receive up to 2 hours of direct contact with one of our experienced solicitors in the family department. If your case requires additional contact, then this will be charged at an hourly rate and can be discussed in advance with your allocated fee earner. 

What is not covered under the fixed fee?

  • Obtaining a copy of your Marriage/civil partnership Certificate
  • Providing detailed advice in respect of issues regarding the children and/or finances of the marriage/civil partnership. Both of these areas are complex in nature. We will provide you with an estimate of charges for dealing with these matters on your behalf, if required in your case.
  • Preparing and issuing an application for substituted service if your spouse/civil partner refuses to return the Acknowledgement of Service to the court. We will make an extra charge of £50 plus VAT in connection with this application and there will be an additional court fee payable in the sum of £105.
  • Any other application in connection with the divorce/civil partnership dissolution proceedings.

 

If your spouse/civil partner is divorcing you or dissolving your civil partnership

£200 plus VAT and disbursements

As the person who is being divorced, acting for the Respondent involves less cost, as you are not responsible for drafting or issuing the proceedings.

We will begin by asking you to complete our Initial Client Questionnaire which will allow us to direct your case to the most appropriate fee earner within our family department.

You will then be invited to have an initial interview.  This can either be a face to face meeting with your solicitor, or a telephone appointment at a time convenient to you. 

We will then write to you to provide you with an overview of the advice we have given.

We will return the Acknowledgement of Service to the Court on your behalf.

We will contact you when the Court has pronounced the Decree Nisi and Decree Absolute.

Clients taking advantage of this option will also receive up to 1 hour of direct contact with one of our experienced solicitors in our family department. If your case requires additional contact then this will be charged at an hourly rate and can be discussed in advance with your allocated fee earner. 

What is not covered by this fixed fee?

  • Providing detailed advice in respect of issues regarding the children and/or finances of the marriage/civil partnership. Both of these areas are complex in nature. We will be able to provide you with an estimate of charges for dealing with these matters on your behalf.
  • Responding to any application made by your spouse/civil partner other than an application for Decree Nisi and Decree Absolute.
  • If your matter is complicated and falls outside the scope of the fixed fee, we will contact you to agree how matters will be progressed on your behalf and how you would wish to pay for our fees.

 

Financial Remedy/Financial Matters

Fixed fees may be available, depending on your individual circumstances.  We will be happy to discuss costs relating to resolution of financial matters at your initial meeting.
